What Is the Adult Use of Marijuana Act? 

California passed the Medicinal and Adult-Use Cannabis Regulation and Safety Act in November 2016. The adult use of marijuana act, which is also commonly referred to as Proposition 64, legalizing recreational use of cannabis for adults 21 years and older.

Effective January 1st, 2017, any adults over the age of 21 in California are legally allowed to possess, transport up to 1 oz of cannabis, as well as 8 grams of cannabis concentrate. Also, adults over the age of 21 are also legally allowed to grow up to six plants at their home in California.

1. Commercial Activity

Under the Medicinal and Adult Use of Marijuana Regulation and Safety Act, commercial cannabis activity has to be licensed in the State of California. This also means that local governments have the power to control need types of cannabis activities that are occurring in their jurisdiction.

The Bureau of Cannabis Control is the government agency that is responsible for licensing cannabis retailers, as well as cannabis Distributors, micro-businesses, and Cannabis Testing labs.

Other business regulations that your business would be required to follow include: 

  • Your business cannot sell or give out marijuana to minors
  • Your business cannot store marijuana in locations where it is illegal to smoke, such as buildings open to the public, bars, and restaurants
