Earlier in my career, I would use experienced attorneys to be mediate disputes for clients because they were relatively inexpensive. I quickly learned that the skills we learned to be attorneys does not translate very well into the skills necessary to help the parties resolve their disputes.

Now, where I represent my clients at mediation, I use primarily use Retired Judges as the mediators. The reason is that a Retired Judge typically was a Judge for a long time and they handled many different kinds of cases in various areas of the law. A Judge has an opportunity to see a lot of different witnesses and different types of evidence. They have made countless determinations about the integrity and credibility of the witnesses and strength of the evidence presented and how the law applies to the facts. I also have found that Retired Judge mediators have a lot of credibility with the parties at mediation.
